TutorsWeb is an online networking community where people connect with each other for services we provide to our members. The document specifies Terms and Conditions under which the services are offered.

Your registration at TutorsWeb or use of any of our services signifies you acceptance of the Terms and Conditions laid down for use of the services provided.

TutorsWeb reserves the right to update, modify terms, conditions and notices of the agreement without need to inform you. It is your responsibility to stay updated regarding our current policies and Terms and Conditions.

By accessing the services, content offered on the site, you agree to bind to the Terms and Conditions we have specified in the document.

If you disagree in part or whole with any Terms and Conditions specified to use our services and content, kindly do not register on TutorsWeb and you will not be authorized to use any services and content at TutorsWeb.

The views expressed on the site do not belong to TutorsWeb and any issues related to them belong to the contributors.

You are required to keep the password safe and not disclose it to any third party. You agree to take the responsibility of every activity and action that is related to your account irrespective of fact the actions have been not been authorized by you.

TutorsWeb provides its members, forums and discussion boards to exchange information and interact. It is understood the information you shared belongs to you and there is no infringement of copyright in whatever information you share.

The content on the website is posted by TutorsWeb and we always ensure the accuracy and integrity of the information posted. However, we do not guarantee the information is complete, current and accurate and TutorsWeb cannot be held responsible for any damage caused due to inaccuracy of the data. If you find any inaccuracy in the information and report to us, TutorsWeb will correct the information within 7 days.

The reviews and opinions expressed on TutorsWeb and the forum and discussions boards belong to users and TutorsWeb cannot be held responsible or liable in any way for the content and its implications.

TutorsWeb reserves the right to delete, block or edit any content posted by users without liability or giving notice to the user. However, we make reasonable efforts to inform about changes to the user.

TutorsWeb Money Back Guarantee policy will protect student payment for a period of 14 days (Or 30% of course/session term whichever is shortest) for Tutor/Course Quality Issues. The Student/Parent can submit an email to support@tutorsweb.com claiming the payment back if he/she is not satisfied with the quality of teaching/content. TutorsWeb reserves the right to validate the claim and approve/reject the claim within 14 business days from the date of receiving the complaint. The session is deemed to be complete if the student is late to class by more than 15 mins from the start of scheduled time.

Tutor is free to set hourly rate or course fee. On receiving the payment from Student, TutorsWeb holds the money till the time of completion of Course/1-1 Tutoring Sessions. After successful completion of sessions, TutorsWeb will release the payment after deducting facilitation fee which is 30% of course fee. A service tax of 14.5% is applicable per order/booking. TutorsWeb can deny payment in case a complaint is received from the paying student/parent as per the terms mentioned in above point. If for any reason, the Tutor is not able to complete the session in time, misses the sessions, comes late to session, TutorsWeb could withhold Tutor's payment.

TutorsWeb will transfer the Tutors payment within 30 days from the date of completion of sessions/course. It is the responsibility of Tutor to provide with accurate bank account details for money transfer. Please send an email to support@tutorsweb.com in case the payment takes beyond 30 days.

All disputes are subjected to the jurisdiction of the High court of Telangana, Andhra Pradesh.

Institutes are treated as Tutors and the same Terms & Conditions apply to them unless there is an overriding agreement between the Institute and TutorsWeb.

Student can cancel a booked session before 24 hours of session scheduled time with cancellation fee of 20% of session fee.

Student Cancellation within 24 hours has a cancellation fee of 80% of session fee.

If student does not turn up to the session until 10 mins of the scheduled session time, the class is considered done and 100% session fee is deducted.

Tutor can cancel a booked session before 24 hours of session by paying a fine of 20% of hourly charge.

Tutor cancelling within 24 hours or not turning up for session will attract a fine of 100% of session fee


While using the website and communicating in any form, you agree NOT to:

Post, transmit or publish any material or content that is false, threatening, derogatory, misleading, defamatory, offensive, invading privacy, promoting racism or posted with bad intention.

Upload any post or information that violates or infringes copyright, patent, trademark, proprietary rights or trade secret of any party

Send unsolicited mail, spam, promotional and marketing messages to promote any products or services.

Create user account using fraudulent information or using automation scripts or software.

Attempt to test the vulnerability and security of the website or break any security measure of the website.


Limitation of Liability

TutorsWeb declares the site, the services and the content is provides as is. There is no guarantee or condition of any kind in any form; Written or in Expression. In no event, TutorsWeb will be liable to the damages for goodwill, loss of profits or data use for using or inability of using our services


Right of Modification

We reserve the right to change or modify the Terms of Use at our sole discretion at any time. Any change or modification to the Terms of Use will be effective immediately upon posting by us. For any material changes to the Terms, we will take reasonable steps to notify you of such changes. In all cases, your continued use of the Sites after publication of such modifications, with or without notification, constitutes binding acceptance of these modified Terms of Use.


Disclaimer

Sites may include forums containing the personal opinions and other expressions of the persons who post entries on a wide range of topics. Neither the User Content (as defined below) on these Sites, nor any links to other websites, are screened, moderated, approved, reviewed or endorsed by TutorsWeb or its participating institutes. By posting to or viewing such forums, you agree that TutorsWeb and any of its participating institutes are not responsible or liable for the content of any postings therein. TutorsWeb reserves the right (but not the obligation) to remove any content from such forums in its discretion.


Rules for Online Conduct

You agree to use the Sites in accordance with all applicable laws. Further, you agree that you will not use the Site for organized partisan political activities. You further agree that you will not e-mail or post any of the following content (“Prohibited Content”) anywhere on the Site, or on any other TutorsWeb


Computing Resources:

Content that defames, harasses or threatens others Content that discusses illegal activities with the intent to commit such activities, or encourages others to commit such activities Content that infringes or misappropriates another's intellectual property rights, including, but not limited to, copyrights, trademarks or trade secrets Content that you do not have the right to disclose under contractual confidentiality obligations or fiduciary duties Material that contains obscene (i.e., pornographic) language or images Advertising, promotional materials, or any form of commercial solicitation Content that otherwise harms other users or visitors to the Sites Content that is otherwise unlawful or that violates any applicable local, state, national or international law. Content that probes, scans, or tests the vulnerability of any system or network Content that breaches or otherwise circumvents any security measures Content that interferes with or disrupts any user, host, or network, for example by sending a virus, overloading, flooding, spamming, or mail-bombing any other user or part of the Sites Content that plants malware or otherwise uses the Sites to distribute malware


Third Party Copyrights and Other Rights:

TutorsWeb respects the intellectual property rights of others. TutorsWeb is an online marketplace where the users upload video/other content for the benefit of students. If you believe that your content does not fall under the fair usage policy or your copyright has been infringed, please send us a notice to contact@tutorsweb.com. Your content will be removed within 7 Business days from receiving the notice and validation of claim as per DMCA Safe Harbor provisions.


DMCA Notice

DIGITAL MILLENNIUM COPYRIGHT ACT NOTICE: The TutorsWeb site, mobile applications, and other online services (“TutorsWeb Services”) operated by TutorsWeb. (“TutorsWeb”) may permit the submission of content and information, including, but not limited to, photographs, video, audio, comments, articles, blogs, forums, information, messages, software, communications and any other material submitted by you and other users ("User Materials") and the hosting, sharing, and/or publishing of such User Materials. You agree to be solely responsible for your User Materials and for any consequences associated with posting or publishing them.

In connection with User Materials, you affirm, represent, and/or warrant that you own or have the necessary licenses, rights, consents, and permissions to use and authorize TutorsWeb to include your User Materials as contemplated by TutorsWeb and these Terms of Use. You may not use TutorsWeb Services to transmit content belonging to any person or party other than yourself, without the prior written consent of such owner. Simply because material is available on the Internet does not mean it is in the public domain. The vast majority of materials on the Internet are protected by copyright and trademark laws.

TutorsWeb does not tolerate copyright infringing activities on its TutorsWeb Services. However, TutorsWeb does not monitor User Materials for copyright infringement.

TutorsWeb abides by the federal Digital Millennium Copyright Act (“DMCA”) by responding to notices of alleged infringement that comply with the DMCA and other applicable laws. As part of our response, we will remove any User Materials if properly notified that such User Materials infringe on another's intellectual property rights.

In addition, TutorsWeb reserves the right to remove User Materials without prior notice. TutorsWeb will also terminate a User's access to the TutorsWeb Services, if he or she is determined to be a repeat infringer. A repeat infringer is a User who has been notified of infringing activity more than twice and/or has had User Materials removed from the TutorsWeb Services more than twice.

While we are not obligated to review User Materials for copyright infringement, we are committed to protecting intellectual property rights and expect users of the TutorsWeb Services to do the same. If you are a copyright owner or an agent thereof and believe in good faith that any User Materials or other content displayed on the TutorsWeb Services infringes upon your copyrights, you may submit a notification pursuant to the Digital Millennium Copyright Act ("DMCA") by providing our Copyright Agent with the following information in writing (see 17 U.S.C. 512(c)(3) for further detail):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled and information reasonably sufficient to permit the service provider to locate the material; Information reasonably sufficient to permit the service provider to contact you, such as an address, telephone number, and, if available, an electronic mail; A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. TutorsWeb's designated Copyright Agent to receive notifications of claimed infringement at copyright@tutorsweb.com

For clarity, only DMCA notices should go to the Copyright Agent; any other feedback, comments, requests for technical support, and other communications should be directed to TutorsWeb customer service at contact@tutorsweb.com . You acknowledge that if you fail to comply with all of the requirements of this Section, your DMCA notice may not be valid.

Keep in mind that you do not need a TutorsWeb account to provide a DMCA notice.

Please also keep in mind that you do not own the copyright to a photo or other work just because you appear in it. If you are unsure about your rights, it may be helpful to first seek legal guidance before contacting TutorsWeb. You may also be able to resolve a matter without involving TutorsWeb by contacting the person who you believe is infringing your rights directly.

Counter-Notice. If you believe that your User Materials that were removed (or to which access was disabled) are not infringing, or that you have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material in your User Materials, you may send a counter-notice containing the following information to the Copyright Agent.

Your physical or electronic signature; Identification of the User Materials that have been removed or to which access has been disabled and the location at which the User Materials appeared before they were removed or disabled; A statement that you have a good faith belief that the User Materials were removed or disabled as a result of mistake or a misidentification of the User Materials; and Your name, address, telephone number, and e-mail address.

If a counter-notice is received by the Copyright Agent, TutorsWeb may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed User Materials or cease disabling them in 10 business days. Unless the copyright owner files an action seeking a court order against the User Materials provider, member or user, the removed User Materials may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at TutorsWeb’s sole discretion.
